TENANTS GUIDE TO SUCCESS

Most frequent questions and answers

With our extensive marketing activity, we may already have your perfect home on our property database, take a look, if not, register now and we will keep you updated with any new property listings we have in the future.

When beginning your search we recommend you to put together a list of the most important things that need to be considered; location, budget, property type etc. This will help you to narrow down your search and limit the time you waste on properties that are not suited to your criteria.

Once you have narrowed down your search, get in touch with our viewings co-ordinator, who will schedule you in, accommodating your busy schedule, we offer evening and weekend appointments.

Property Viewing – In order to submit an application for the property, we require you to visit the property with our expert letting’s negotiator, who will go through the overall expense of the property, answering questions and providing you with our marketing brochures and application form.

Let as Seen – All properties are let as they seen, if any requests are to be put forward before applications are processed. If your request is constituting to your deciding factors/ conditions of your tenancy, you must ensure you receive a firm written response before proceeding. This means that the property will remain on the market until all documentation and monies have been received in order to secure it.

Application Form – After the viewing and the property is right for you, we will require all tenants that are looking to move into the property to complete an application form, this including information about yourself, guarantor and consent to terms and conditions.

Personal Identification – All tenants are required by law to provide two forms of identification, this can include; driving licence, passport, utility bill, academic ID (college or university). One form of identification must include your photograph i.e. driving licence or passport.

Guarantors – Applicants are required to provide a UK based guarantor whom will be referenced, alongside yourself, alternatively a minimum of six-months rent in advance would be required; depending on the terms of the tenancy.

Referencing – This is carried out by Home Let, whereby income, credit and employment information will be evaluated. On average this can take three to five working days. Please note to advise your referees to reply in a timely manner in order to speed the process up. Should you fail the referencing process, the landlord may still accept the tenancy provided the guarantor is fully referenced, should this be required there is an additional cost of £100.00 per guarantor.

Tenant Holding Sum – This amount is to be paid prior to moving in, in order to secure the property and take it off the market. We ask that one weeks rent is paid, in line with the Tenant Fees Act (2019).

Deposit – This amount is to be paid prior to moving in and is the amount of five weeks rent. Please note; this with be retained if either tenant or guarantor withdraw from the process. Once the Tenancy Agreement has been signed, and key exchanged the deposit will be insured under a Deposit Protection Scheme.

Stage One – Requires Immediate Attention:

  • Online referencing Application Form, this will be sent via email.
  • LA Property Discovery Application Form
  • Tenancy Deposit Scheme Form
  • Right to Rent Documentation
  • Read and Sign Tenancy Agreement – the property cannot be secured until this has been signed
  • Pay non-refundable Tenant Holding Sum

 

Stage Two – Required to Provide:

  • Proof of ID – Original documents of Passport, Driving Licence or Birth Certificate
  • Proof of Address – Utility bill or an official letter dated within the last three-months
  • Proof of Earnings – Three-months’ pay slips and one-months’ bank statement dated within three-months. Those that are self-employed we would require three-years audited accounts and for students, evidence of course and student card.

 

Stage Three – LA Property Discovery

  • Continuing Guarantee/ Supporting documents, to include; Proto ID/ Proof of Signature (passport, driving licence) and proof of earnings/funds (three-months’ worth) or proof of home ownership (required to be permanent UK resident)

 

Stage Four – Clearing of Outstanding Monies and Keys Released

  • Payment – Within seven-days of applying for a property, you are required to pay the outstanding monies in full, consisting of tenancy/ property deposit and rent in advance. All funds must be cleared and paid via bank transfer.
  • Deposit – This amount will depend on the property, on average is equivalent to five-weeks rent.
  • Rent – Rent will be collected on the 1st of each month. Prior to 15th of the month, the rent is calculated pro-rate. On or after the 15th of the month the rent from the date the tenancy commences to the end of the month along with the second months’ rent in full.

 

Stage Five – Moving Day

  • Collect keys & LA Property Discovery’s Welcome Pack Documents
  • Complete standing order mandate provided and post to bank. It is your responsibility to ensure that the mandate is in place before first rent falls due and that your rent is paid on time each month, to prevent charges being incurred.

RENTAL POLICY

IMPORTANT INFORMATION

RENT DUE

All rent is due in cleared funds on the date stipulated within your tenancy, with most being due first day of each calendar month. The payment method preferred is by Standing Order Mandate.

You will be given a specific folio number at the commencement of your tenancy to quote on your mandate, this enables our system to identify and process your payment quickly.

Please ensure that the mandate is set up in time for funds to be received on the date due i.e. 1st of the month.

MISSING RENT

Standing Order payments may not arrive in our account for a variety of reasons, including;

  • Insufficient funds in Account
  • Cancellation of a Standing Order Mandate by Account Holder
  • Failure to process/ set up the Standing Order Mandate

 

It is the Tenants’ responsibility to ensure that payments are received in full and on time.

LATE RENT EXCEEDING FIVE-WORKING DAYS

Outstanding rent matters exceeding the five-day working period will be passed over to an outsourced legal team.

The administrative fees – starting from £150.00 (+VAT) are aimed at those tenants who fail to pay rent and are intended to cover the cost of credit control and administratioN

LATE RENT POLICY

If rent is late or if it does not arrive at all, the Landlord still has their own obligations such as mortgage payments.

It is not the Landlords’ nor LA Property Discovery (managing agents’) responsibility to chase the Tenant for rental payments. It is the responsibility of the Tenant/s to ensure that their rent is paid promptly and on time, whilst taking necessary measure to check that the payment has been made.

Under the terms of a lease agreement, all rent must be paid on the due date. The terms of the lease to which you and your guarantor have agreed stipule that if you are in a shared property, all tenants and guarantors are liable for any missing rent/rent arrears and any associated costs as a result.

If rent is missing, an automated letter will be sent to you stating the arrears. Such letter will raise a rent arrears charge on your account. Additionally, you may also receive email correspondence and/or a telephone call. It is the responsibility of all tenants to make payments of any amounts outstanding, to include charges such as rent arrears charges.

Failure to pay your rent once correspondence has been sent to you chasing your arrears, or you have been contacted by telephone, you will be charged for each reminder thereafter at no less that £35.00 (+VAT) for each instance. In each case rent and or late payment fees still remain outstanding, additional charges may apply including debt recovery costs.

Please Note; In the case that there are insufficient funds or if the Standing Order Mandate is cancelled or failed, LA Property Discovery or your landlord do not have authorisation to speak to the Tenants’ bank.

LEGAL ACTION

Ultimately in the case where no rent is paid, or where rent is continually later and arrears have accrued, we will on the instruction of your Landlord, hand over the rent recovery to a debt collection agency or legal firm to collect the rent arrears and any charges and where necessary proceed to eviction. The decision to commence legal action lies with the Landlord and not LA Property Discovery.

If Court action is found necessary, your Landlord is likely to request that it will be raised against all Tenants’ and usually Guarantors. In the likelihood this occurs, the Court will order for you to repay the debt and in most cases you will also be ordered to give up possessions of your home/rental accommodation and pay for any associate costs including Court costs.

The Courts have the power to ultimately arrest bank accounts, property and wages. In very extreme case an individual can be declared bankrupt.

Please note, a County Court Judgement is likely to impact on credit rating which may hinder you finding alternative rented accommodation and also mortgage applications and other credit
